Part IAuthorisation and Procedure

1 Notice to Treat

(1)No minister, department, or local authority shall enter upon or take possession of private land without statutory authority under a Compulsory Purchase Order.

(2)Before taking land, the acquiring authority shall serve a notice to treat upon every owner, lessee, and occupier having an interest therein.

Part IICompensation

2 Assessment of Compensation

(1)Compensation shall be assessed by the Lands Tribunal upon open market value, with reasonable compensation for injurious affection and disturbance.

(2)No land shall be taken by the Crown or public bodies without prompt payment of the assessed compensation.

3 Citation

This Act may be cited as the Compulsory Purchase and Compensation Act.
