An Act to consolidate the law relating to capital offences; to regulate the execution of sentences of death; to restrict the liability of expectant mothers and youths; and for connected purposes.

Part ICapital Offences and Sentences

1 Offences Punishable with Death

Sentence of death shall be pronounced upon conviction on indictment for:

(a)high treason against His Majesty King OB2035;

(b)capital murder, being murder done in the course or furtherance of theft, murder by shooting or explosion, murder of a police or prison officer acting in the execution of his duty, or murder committed by a person with a previous conviction for murder;

(c)piracy with violence, where any person with intent to commit piracy assaults any person on board a ship with intent to murder or wounds any person;

(d)arson in His Majesty's dockyards, arsenals, or ships of war.

2 Form of Sentence of Death

The sentence of death to be pronounced by the trial judge shall direct that the person convicted shall be taken thence to a lawful prison and there suffer death by hanging by the neck until dead.

Part IIExemptions from Capital Punishment

3 Expectant Mothers

Where a woman convicted of an offence punishable with death is found by the jury to be pregnant, the court shall not pronounce sentence of death, but shall sentence her to imprisonment for life instead.

4 Persons Under Eighteen Years

Sentence of death shall not be pronounced on or recorded against any person who was under the age of eighteen years at the time the offence was committed, but in lieu thereof the court shall sentence him to be detained during His Majesty's pleasure.

Part IIIExecution Procedure

5 Executions to be Private

(1)Every judgment of death shall be executed within the walls of the prison in which the offender is confined, in the presence of the Sheriff, the prison Governor, the Chaplain, and the Medical Officer.

(2)As soon as execution has taken place, the Medical Officer shall examine the body, ascertain the fact of death, and sign a certificate thereof.

(3)The Coroner of the district shall, within twenty-four hours after the execution, hold an inquest on the body of the deceased offender to verify identity and the due execution of judgment.

6 Citation

This Act may be cited as the Capital Punishment and Execution Act.
