An Act of Tynwald to regulate the sentence and execution of death; to define capital felonies in the Isle of Man; to reserve the Royal Prerogative of Mercy; and for connected purposes.

Part IPronouncement of Judgment of Death

1 Capital Offences in the Island

(1)Any person convicted before the Court of General Gaol Delivery of high treason against His Majesty King OB2035, Lord of Mann, or of wilful murder, shall be sentenced to suffer death.

(2)Sentence of death shall be pronounced by the First Deemster or Second Deemster wearing the black cap, directing the prisoner to be hanged by the neck until dead.

2 Exemptions for Youths and Pregnant Women

(1)Sentence of death shall not be passed on any person who was under eighteen years of age at the date of the crime, and such person shall be detained during the pleasure of the Lord of Mann.

(2)If an empanelled jury of matrons finds that a convicted woman is quick with child, sentence of death shall be respited and commuted to penal servitude for life.

Part IIExecution and Prerogative

3 Execution of Sentence

(1)Every execution of a capital sentence shall take place privately within the walls of the prison in the presence of the High Bailiff, the Gaoler, the Chaplain, and the Surgeon.

(2)The Sheading Coroner shall oversee the execution of the judicial warrant delivered by the Deemster.

4 The Royal Prerogative of Mercy

Nothing in this Act shall affect the royal prerogative of mercy, which may be exercised by His Majesty King ob2035, or by the Lieutenant Governor acting on His Majesty’s behalf, to grant a free pardon, a conditional pardon, or a respite of execution.

5 Citation

This Act may be cited as the Isle of Man Capital Punishment Act.
