Part ISentences of Birching

1 Power to Order Birching

(1)Where any male person is convicted before the High Court of Justice or a High Bailiff of any felony accompanied by personal violence, the court may, in addition to or in lieu of imprisonment, sentence the offender to be once privately whipped.

(2)The instrument used shall be the birch rod, and the order of the court shall specify the number of strokes, which:

(a)in the case of a person under the age of fourteen years, shall not exceed six strokes;

(b)in any other case, shall not exceed twelve strokes.

Part IIExecution and Medical Attendance

2 Medical Supervision

Every whipping or birching shall be administered privately within the prison or police station by a constable in the presence of the Medical Officer, who shall certify the fitness of the offender to endure the punishment.

3 Citation

This Act may be cited as the Isle of Man Corporal Punishment Act.
